Cade and Emma

The small claims court sent there decision and although I did not win I do feel at peace. I know I told the truth and that is what is most important to me. Because I wanted to know where Cade was and for his new owners to know he would always be welcome here, according to the courts that changed the agreement on Emma’s pup, so that Mrs. Kronheim-Huntington Woods Collies in Wellington did not have to pay the financial equivalent on the pup. Even though Mrs. Kronheim admitted she owed me the pup, the small claims court stated they can not make her give me the pup (as they only deal with monetary awards) I can appeal to the upper courts who can order transfer of the pup, as she is owed to me.

I still have verbal agreements with friends, that I have no doubt will be honored. My word is very important to me, so I never felt a need for a written contract. But, because I did not have a written contract I could not prove the agreement so from now on as the Judge advised there will always be a contract written out.

All I wanted was to know that Cade was safe. I feel an obligation to my puppies. I am thankful to the AKC for sending them a letter letting them know he is always welcome here, if there is ever a need for them to place him. It is a shame the AKC had to be involved. Mrs. Kronheim should have returned Cade at 11wks, she should have informed me she was selling him as I would have taken him back at that time- I found out from a friend I asked to let me know how he was doing, had she told me where he went so that I could have informed his owners of my commitment to Cade, I would not have had to ask for help in locating him on my web site or from the AKC.

Had Mrs. Kronheim been honest in stating the reason she had not registered the litter of Emma’s pups was because she was waiting to find out who the sire’s of the 2 pups where, then I would have known she did plan on registering the litter. Instead, she kept stating she was waiting on the AKC litter registrations – which AKC even sent a letter in March stating she had not applied for the litter registration. Mrs. Kronheim kept saying she would take the pup to my veterinarian and calling them for hours, and never took the pup to them, the paperwork I sent her was written the way the AKC suggested, as it was the exact same information that would have been on the AKC application while waiting for the official papers to be delivered.

My reason for taking Mrs. Kronheim to court was on the dogs was not for finances, it was to find out where Cade was and to get the pup from Emma that she stated she was taking to my vet over and over during a 6 wk time frame.  So even though I did not win the law suite due to lack of proof as the agreements where verbal, I know I was telling the truth and that my word is as good as any signature on a piece of paper. It is very sad that other people due not have the same ethic's and even sadder when they claim to be Christians, but God knows the truth and his judgment is the one that really counts.
